1. General information

Here we inform you about the processing of personal data during your visit to our website. Personal data is any information relating to an identified or identifiable natural person (hereinafter "data subject").

The party responsible for the processing of data processed during visits to and interaction with this website, as well as the responsible data processor to whom the rights of the data subject may be exercised, is:

2. Applicable law

This data protection information covers data processing in accordance with the regulations of the currently applicable version of the EU General Data Protection Regulation (GDPR) as well as the currently applicable Swiss Data Protection Act (DSG), which came into force on 10.9.2023, together with the associated Data Protection Ordinance (DSV).

The DSG applies to data protection matters that have an impact in Switzerland, even if they are initiated abroad. The GDPR essentially applies to the processing of personal data of data subjects located in the Union by a controller not established in the Union.

The data processing at PXL Vision is generally carried out according to the principles of the GDPR, unless otherwise regulated. Accordingly, the processing according to Art. 6 GDPR takes place on the basis of corresponding permission norms, which also ensures a permissible data processing according to the principles named in Art. 6 DSG.

3. Collected data and data categories as well as processing purpose

a.Data collection and storage during website visits

When you visit our website, we collect and process technically provided personal data, such as log data and metadata, as well as data generated by cookies with the corresponding consent.

We process this data for the purpose of providing our service (Art. 31 DSG, Art. 6 para. 1 b) GDPR).

Of this metadata, the following data is logged and stored (log file): The requested website URL as well as the URL of the website from which the file was requested, the visitor's stored cookies for the accessed domain, the status of the access (file transferred, file not found, etc.), date and time of the access, amount of data transferred during the connection, type and version of the browser used, language used and your IP address. We log this data for the identification and elimination of technical faults and to improve the quality of our services (Art. 6 para. 1 f) GDPR). For these purposes, your IP address is processed and shortened by the last octet. If there are concrete indications, also for the purpose of detecting and preventing misuse and fraud, website visit data may be processed (Art. 6 para. 1 f GDPR). For this purpose, data from log files of different systems may be merged and aggregated. If necessary, evaluations are also carried out with other customer data.

Log files are generally stored according to the fulfillment of the specific purpose and deleted if they are no longer required to achieve the purpose. In particular, in the event of a violation of legal rights or in a corresponding case of suspicion, the log files concerned may be retained in individual cases until the matter has been clarified and, if necessary, for further prosecution (e.g. in the case of criminal offenses such as fraud). This applies accordingly to cases of errors and malfunctions until they have been rectified.

b. Data collection when contacting or interacting on the website

Furthermore, we may collect and process additional personal data if this is necessary for the specific process initiated by the user. For example, in the case of contact requests or chats, the names and addresses of the users may be required, and when contact is made by e-mail, the corresponding data in the e-mail and data related to the transmission and processing of the e-mail may be processed.

PXL Vision uses the services of google as an email provider, so that when contacting us by email but also when using other social networks, users must take into account that the data associated with the email or via contact options via social networks can be processed on servers outside the European Economic Area. If you contact us, for example, by email, social media or other means, the confidentiality of the communication cannot be guaranteed when using these contact options, as it cannot be ruled out that the providers of these contact options (possibly on the basis of the terms of use concluded with you) have access to the contents of the communication. If applicable, the confidentiality of the communication also depends on the privacy settings you have made with these providers.

c. Marketing emails (e.g. newsletter)

You will receive a newsletter if you register for a corresponding service on our website (Art. 6 para. 1 p. 1 b) GDPR). The data you provide will only be processed to provide the newsletter. To unsubscribe from the newsletter, simply click on the unsubscribe link in any email from us, which is present in each of our newsletters. Subsequently, you will not receive any further newsletters from us of the booked newsletter service.

d. Personalized videos, images and banners

You may see a video, images or banners on our website based on your technical data or permitted cookies. For this purpose, we do not use sensitive customer data (but e.g. only the industry or country which we could identify via an analysis service provider (Leadfeeder (see below)). The processing is based on the provision of the service and, if applicable, your consent (Art. 6 para. 1 p. 1 a,f GDPR) or the cookie settings. You will receive further information on the purposes and your revocation options when giving your consent. We collect statistical information (e.g. the number of link clicks) to measure the success of the service (Art. 6 para. 1 p. 1 f GDPR).

d. Embedding external content

We include content from third-party providers on our website. For this purpose, your browser may establish a connection to the servers of these third-party providers and transmit personal data to these servers. f. Information on the use of cookies, pixels and similar technologies

This website uses these cookies to provide the best possible user experience and to provide us with statistical information about demand and user interests.

In particular, we use so-called retargeting techniques. This allows us to reach users of our website again on other websites and platforms and present advertisements via advertising networks, i.e. providers of online advertising banner space. For this purpose, the pixels mentioned below are integrated on our website. These identify users via cookies or UserIDs of the respective network and add them to target groups which can then be used by us to play out advertisements on the respective network. In addition, the advertising networks use the data to create so-called "lookalike audiences", i.e. to create target groups with users with similar profiles. 4. Data protection advisor/data protection officer

PXL has appointed its own expert and legally competent employee as data protection officer, who regularly checks compliance with data protection regulations.

5. Technical and organizational measures

When processing personal data, PXL uses state-of-the-art technical and organizational measures to protect this data from loss, destruction, unauthorized access and unauthorized disclosure. (Art. 8 DSG, Art. 32 GDPR)

Among other things, PXL Vision operates an information security management system (ISMS) to ensure compliance with technical and organizational measures. The ISMS has been certified by independent third parties in accordance with ISO/IEC 27001:2013 and is regularly reviewed by internal and external audits. Part of this ISMS is a data protection concept, which includes a continuously updated processing directory and, if required, data protection impact assessments.

6. Your rights

Within the meaning of the DSG and the GDPR, data subjects are generally entitled to the following rights:

a. Rights of access and rectification
  • You have the right to obtain information about your processed data (Art. 25 DSG and Art. 15 GDPR).
  • You have the right to have incorrect personal data corrected or incomplete data completed (Art. 32 DSG and Art. 16 GDPR).
  • You have a right to have your personal data deleted under certain legal conditions (Art. 32 DSG, Art. 17 GDPR).
  • You have a right to restrict processing under certain legal conditions (Art. 32 DSG, Art. 18 GDPR).
  • You have a right to receive or transfer the personal data concerning you under certain legal conditions (Art. 28 DSG, Art. 20 GDPR).
  • You have the right to revoke your consent to the processing of your personal data at any time with effect for the future. The lawfulness of the processing carried out on the basis of the consent until the revocation remains unaffected by the revocation. You can declare a revocation by sending a message to privacy@pxl-vision.com.

Alternatively, you can send your request in writing to the above address. In addition, you have the right to file a petition or complaint with the supervisory authority. For this purpose, you can contact the respective competent data protection supervisory authority.

b. Your right to object

You have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data carried out on the basis of Article 31, Article 6(1)(f) GDPR; this also applies to profiling based on these provisions. We will then no longer process your personal data for these purposes, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the assertion, exercise or defense of legal claims. You can submit such objections to us using the contact details provided. If we process your personal data for the purpose of direct marketing, you have the right to object at any time to the processing of such personal data for the purpose of such marketing; this also applies to profiling, insofar as it is related to such direct marketing. We will then no longer process your personal data for this purpose.

 

7. Places of data processing

We generally process your personal data only in Switzerland, Germany and the European Union. If, in individual cases (such as the connections to external providers outlined above), personal data is processed outside of this region, PXL Vision indicates this in this policy and has, at the same time, entered into corresponding agreements with these companies to comply with data protection obligations in accordance with the standards of the DSG and GDPR. 

 

8. Data recipient

Employees of our company and service providers who support us in data processing as part of contract processing (service providers for IT operations, customer service) have access to your personal data to the extent necessary to fulfill the aforementioned purposes. In individual cases, we are legally obliged to transmit personal data to authorities (e.g. requests for information from investigating authorities) or natural/legal persons (e.g. to assert claims). Further information on possible recipients of your personal data can also be found in the preceding sections.

9. Amendment of the data protection declaration

Since changes in the law or changes in our internal company processes may make it necessary to adapt these data protection provisions, we reserve the right to make changes.
